Yesterday the United States filed a motion to hold Benson in contempt for failing to comply with the Court's injunction, alleging Benson contumactiously refused to mail a copy of the injunction to his any customer other than the 7 identified by the government in its motion for summary judgment. (See Doc. 156). The government argued that Benson's assertion of his rights under the Fifth Amendment constitutes proof of non-compliance.

This morning we filed our opposition including a declaration which I prepared. See Docs. 157 and 157-2).

The hearing is set for Thrusday, Feb. 28th, the same date as our motions to quash the IRS admin summons and hold IRS personnel in contempt. I'll keep you posted.
