You are aware from my last update that the court did not hold a hearing on February
28, 2007, but instead ruled on the three pending motions. One of the court's
rulings included an order that Benson file another declaration showing he is in
full compliance with the permanent injunction. The government had argued that Benson
was in contempt of the court's order because he asserted his Fifth Amendment
right.
On March 1st we prepared and sent a motion to the 7th Circuit Court of Appeals to
stay the court's order. A copy is attached hereto as a .PDF file. In the near
future I will update my website to include copies of the documents filed in the
7th Circuit.
I am in the process of working on the appellate brief in the event the 7th Cir.
refuses to certify, to the Supreme Court, the eight questions which we have asked
it to certify. Another reason for starting the brief is that I want to timely send
it to those individuals and groups that typically file amicus curiae (friend of
the court) briefs to allow them ample time to study the issues and decide if they
want to participate.
We are hopeful that these potential people will consider the First Amendment freedom
of speech issue and the Fifth Amendment due process issue of sufficient importance
that they will want to participate. Another issue which they may or may not embrace
is whether the Enrolled Bill Rule and Revised Statute 205 are in violation of article
V of the Constitution of the United States of America. I have identified about 50
individuals and groups that we will target.
A subset of obtaining favorable results on any of the eight questions is that it
starts to spell the demise of the 16th Amendment. The Ron Paul campaign to repeal
the 16th Amendment, as well as the interest in the Fair Tax Act, we are hopeful,
presents some political impetus for the court to consider the issues that are raised
in the Benson litigation.
We also want to raise public awareness, and increase political support, by running
ads in several mainstream newspapers. An intense letter writing campaign to all
three branches of government wouldn't hurt either. In any event, this all requires
funding. Bill Benson lives off of social security payments part of which is being
levied by the IRS. I am representing Bill for free and living off of credit card
debt. Obviously, neither Bill nor I have the funds to pay for the work that needs
to be done.
