Dear Ms. Pelham,
My name is Jeffrey A. Dickstein. I am an attorney and have been for the past 31½
years. I am currently involved in litigation that recently went from the trial court
in the Federal District Court of Northern Illinois, Eastern Division, to the 7th
Circuit Court of Appeals.
In this litigation the United States sought an injunction against my client to enjoin
him from expressing an opinion on a political subject, alleging his opinion was
false. When we submitted documents certified by the Secretaries of States to prove
his opinion was true, the District Court held the evidence was irrelevant and immaterial,
and struck the documents from the record.
The attached article is
one I wrote that was recently published in a magazine. I am sending it to you to
obtain wider circulation because I believe the people of this country need to understand
what is happening in our federal courts. The District Court's actions have,
for all intents and purposes, eliminated both the First Amendment right to freedom
of speech and the Fifth Amendment right to due process of law.
